In these terms and conditions the following definitions apply:


“The Company” is Medevolve Ltd


“Customer” is the individual, company or organization placing an order for goods or services with Medevolve Ltd or requesting information from Medevolve Ltd


“You” or “your” refers to the customer


“Medevolve”, “we”, “us” or “our” refers to Medevolve Ltd


“The User” is any person who uses or attempts to use any items supplied by Medevolve Ltd




All orders are accepted by Medevolve Ltd subject to these conditions.  No variation of these conditions will be accepted by Medevolve unless previously agreed in writing.




Customers entering into transactions with Medevolve Ltd expressly warrant that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are, or may become, interested in Medevolve Ltd products, whether in whole or part.




Details and specification are correct at time of publication but may be changed without prior notice.  Medevolve reserves the right to alter specifications of any given product and to withdraw any item without explanation or notification.  All pictures/images are for illustration only.




All prices are subject to change without notice.  All prices are subject to VAT at the current standard rate.




Payment must be received by Medevolve Ltd prior to the despatch of goods.




Any time or date stated for delivery is an estimate only.  All effort will be made by Medevolve Ltd to despatch goods on time, but Medevolve Ltd does not accept liability for failure to deliver within the stated time.  If Medevolve Ltd is unable to deliver the goods within 30 days of the date of the order, the customer will be entitled to cancel the order and have a full refund.


 · Medevolve Ltd does not accept liability for shortages or damage to deliveries unless the customer notifies Medevolve Ltd of the shortage or damage in writing within 3 days of receipt of the delivery.


 · Delivery is deemed to have taken place when the goods are delivered to the customer's nominated address, whereupon the risks of loss, breakage and all damage shall pass to the customer.


 · Title of the goods does not pass to the customer until payment is received in full by Medevolve Ltd.


 · The customer has to accept the goods when they are ready for delivery.






Medevolve Ltd will endeavour to meet customer's individual requirements, but Medevolve shall be under no obligation to accept cancellation or amendment to any order or any part of an order.  Where such cancellation or amendment is accepted prior to the despatch of an order, it is on the understanding that a cancellation or amendment charge may be levied.






The return of goods will only be accepted with the prior agreement by Medevolve Ltd.  When such return of goods is accepted, it is on the understanding that a cancellation or amendment charge may be levied and at no time will the delivery charge be refunded.  Such goods must be unopened and in perfect re-saleable condition.






Medevolve Ltd makes every effort to supply the goods as advertised, but reserves the right to vary the specification without prior notice.  In the event Medevolve is unable to supply the goods ordered by the customer, Medevolve reserves the right to offer goods of equal or superior specification at no extra cost.  If the customer does not wish to accept the alternative offered, they may cancel the order for a full refund of any money paid for that order.


Products supplied by Medevolve Ltd are warranted to be free from defects in workmanship and materials and fit for the purpose for which they would normally be used.  Customers are advised to check suitability and specifications of products before ordering.






Under no circumstances shall Medevolve Ltd be liable for any consequential or indirect damage or loss, however, caused, including, but not restricted to, loss of profits, goodwill, damage to trading relationships and financial loss. Medevolve's liability in respect of all other losses shall be limited to the invoiced value of the relevant order.






Delivery against the contract may be suspended pending any contingencies beyond our control and Medevolve Ltd shall not be liable for any loss or damage occasioned to the customer thereby.






The contract shall be governed by and construed according to the English law and the purchaser submitted to the jurisdiction of the English courts.  These terms of trade will prevail over any conditions that shall be issued by the customer.






Customers qualifying for VAT zero rating must supply a VAT Relief Form with their order.  Such VAT Relief Forms must be emailed, faxed or posted to Medevolve at the time of placing the order.
